Fees & Charges

You agree to pay all fees and charges applicable to your account(s) with us. Our current fee schedule is available on our website and may be updated from time to time. Fees may include, but are not limited to: monthly maintenance fees, overdraft fees, ATM fees, wire transfer fees, and foreign transaction fees. You are responsible for any third-party fees that may apply, such as ATM operator fees. We may deduct fees directly from your account balance. If your account does not have sufficient funds to cover fees, we may overdraw your account or take other actions as permitted by law.

Liability

To the fullest extent permitted by law, Advantage Federal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from: (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; (c) any unauthorized access to or use of our servers and/or any personal information stored therein; (d) any interruption or cessation of transmission to or from our Services; (e) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Services. Our total liability to you for all claims arising out of or relating to these Terms or your use of our Services shall not exceed the amount of fees you paid to us for use of the Services during the six-month period preceding the event giving rise to the claim.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our Services shall be resolved in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of such courts. We make no representation that our Services are appropriate or available for use in locations outside the United States. If you choose to access our Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
